So, what if you were in your local Wal-Mart store, browsing around when from nearby, or the next aisle over, you heard some foul-mouthed woman spewing expletives?  What if you had your minor children with you, or your 80-year old mother, or your wife?

I, for one, would go around to the next aisle just to see what sort of trashy mouthed person was bellowing loud enough to be heard the next aisle over.  From that point on, circumstances would dictate my next action.

But in the case of Assistant La Marque Fire Marshal Alfred Decker, who found himself in this exact circumstance, the decision was simple.  Decker is a 'police officer.'  He is a sworn, certified Texas peace officer, complete with the power of arrest and authority to write tickets.  Just because his primary assigned duty is investigating fires and fire code violations, does not minimize his authority as a police officer.

So, when Decker heard a dirty-mouthed woman uttering the F-word within earshot, he discovered it coming from a 28-year old woman, with a 2-year old baby slung up up on her hip like a bag of potatoes, upset because batteries she needed were not on the store shelf.

I don't know about now, but years ago there were laws against public obscenity and I know of police officers who have actually put people in jail for the very thing that woman in Wal-Mart said.  Public obscenity means using foul, repulsive, or detestable words in public.  I don't think anyone would argue that the F-word is considered to be foul, repulsive or detestable, and there is also no doubt that inside a Wal-Mart store is in the public.

But rather than gather the woman up, call the CPS to come get her baby, and throw her and her dirty mouth in the slammer, officer Decker did what he felt he was compelled to do without taking those extreme measures.  He wrote her a ticket for 'Disorderly Conduct.' 
Disorderly conduct statutes give police officers and other authorities fairly broad discretion to arrest people whose activities they find undesirable for a wide variety of reasons, such as being loud and obnoxious, or using foul, obscene or profain language in a public place and a whole slew of other reasons. Potential punishments include a jail term, fine, probation, restraining orders,community service.

The woman in Wal-Mart fit that description and Decker slapped her with a ticket, and we say he did the right thing.

But as in so many cases, when these types are caught, when they find they can't just run around anywhere they want to, talking trash talk, being dirty mouths,  spewing filth in public around decent men, women and children, they seek ways to take revenge on the officer who called their hand.  Often they will call the officer's supervisor, or the internal affairs investigator, or the police chief.  And often they will call a local newspaper or TV station in an effort to make a public issue of the incident and bring pressure on the officer.  And again, that's what happened in this case.  The woman called the local newspaper and the incident made page one.

The newspaper's lawyer is now demanding a copy of the citation issued by Decker.  For what?  It's a ticket.  Just like a speeding ticket only it says Disorderly Conduct.  Of course the Muncipal Court in La Marque doesn't want to give it up, so now the fight is on between the court and the newspaper, and the big story of the day is over a police officer who did the proper and decent thing and put a cork in the mouth of a woman whose normal and usual vocabulary is laced with filth, even in front of her 2-year old child.

Guess what we can expect from that child in a few years.

Dear Editor, Last time I checked you cannot breach the peace to a police officer without a third party complainant filing the charges or swearing to a signed complaint. The woman should watch her mouth in public but unless someone else other than the police officer heard her profanity I don't see a conviction here.

Wrong: Where do you get that kind of information?  If that were true, the police would hardly ever make an arrest because many of the arrest made are when the officer is the only one to see the offense occur.  In addition, when an officer sees, or in this case hears, an offense occur and fails to act, he/she may be disciplined for dereliction of duty.  Editor


The Police officer alone cannot be offended. The foul language has to offend another party. I am sure that Officer Decker gave the woman the oppotunity to quiet down and her behavior dictated the outcome. As usual the second guessers who have never wore a badge or stood up to anyone doing wrong know how to do it better. I commend Officer Decker for caring enough to take action. I am sure the the whole incident could have easily been resolved with a simple "sorry". I realize people were nervous and upset with the prospect of an approaching storm. It is not unbelievable that nerves fray and expletives pop out. It is the duty of uniformed officers to maintain order. What if an offended third party solved the problem by using force. The second guessers and arm chair quarterbacks never think about how many shootings, stabbings and beatings result from verbal outburst. Allow the Municpal Court to judge this case. The officer did his duty. Release the ticket there is nothing to hide.


What I want to know is why in the world is this so called fireman wondering around this town strapped with guns. Lo and behold that the usual news you hear about a fireman is that he put out a fire and saved some lives or something to this effect.This guy uses his athority like he is the chief of police. how ironic as it seems is that a friend of mine went to La Marque city court over a dispute with trash being dumped on his property and Barney Fife there was the Bailiff acting as if he was leading defendants by the arm into congress. That guy definitely has some issues.

He is not a 'so-called fireman.'  He does not fight fires.  He is a fire detective.  He finds the bad guy that burns your house down and kills you in it. Editor


What's Wrong With The F-Word Anyway? COMMENTARY Dear Editor I would agree that the language she used is totally inappropriate. However, if his primary job is a Fire Marshall, it was improper to act in this manner. There were other ways of handling this situation, especially with the impending tropical storm. If he wants to be a Police Officer maybe he should find a job with the police department, not the fire department. What department is carrying his commission anyway? Just because you are TECLOSE certified does not mean you are an active Peace Officer. As a side note, maybe we could get Bayou Vistas speeding problem taken care of since he is a Certified Texas Peace Officer and he works for LaMarque. The speeding seems to be much more of a safety issue than some foul mouthed woman in Wal-Mart. Thanks! M. Fagan League City

Breck, I certainly agree with you. No one not of the same mind set is goiong to be insulted and angered. It is justice that the officer was nearby. Ch 11 news said something about a person committs no ofence if cursiing a police office. Ch 11 will say just about anything to make a "story". Ch 11 quoted the Supreme Court of the United States... funny with all my years as peace officer I was not aware of such a stupid thing. Anyhow, I agree with your positition. I commend the officer for ticketing the foul-mouthed woman in Wal-Mart. Obscenity laws are not enforced in this country, generally, for fear of lawsuits or reprisals. What has to be understood by foul-mouthed people is that they truly are offensive. Just because these perverts are personally accustomed to verbal and mental filth, many twisted, foul-mouthed people believe that others' standards should lower to their level. I believe that many violent incidents are preceded by outrage against offensive, obscene language. When law enforcement officers enforce obscenity laws, they prevent ordinary citizens from having to take matters into their own hands. My hope is that many more people will be ticketed for using the F-word, especially people who blast the word around town with their car stereos. And "P.S." not all bad words can be explained away as a cultural expression. There seems to be a contest out there to see who can come up with the most offensive sexual suggestion.

And notice how many readers side with her and take offense with the officer. (Editor)

As a grandmother with 4 grandchildren,that I take to Wal Mart,I say thank you to the officer(and he is a officer).I have encountered such people and it does offend me.I Do Not curse in front of my children,grandchildren or other peoples children.And I expect the same.I am glad someone is standing up for the decent people.And she went before the news like she did nothing wrong.Lady you should be ashamed of yourself.You should of apologized and dropped it.

As we all know, many people in today's society feel that they can do or say whatever they want, just because. Well I don't want to hear their filthy words, so those of us who think it is wrong have just as much right as those who think that it is not wrong. A ticket from an official is the least that can be done. Personally, I think a more physical punishment would be more appropriate.

Right on, I wish there were more of you out there writing tickets to these potty mouth people who think it`s there God given right to say what ever in front of who ever in public, with no respect to thereselves and anyone around them. I myself don`t want to hear that kind of language. I feel very sorry for the lady`s child. It sounds like they have no role model to teach them respect. She doesn`t even respect herself.

So what if she dropped the F-bomb? Have you ever been in the Galveston Wal-Mart? For that matter, have you ever stood in line at the movie theater or wherever else teenagers gather? F-bombs all over the place! I don't see anyone giving out tickets at the movies. Ususally, if I hear it, I just stare the offensive punk down & try to shame them. It ususally hits home.

TRASH. I wouldnt want my children listening to those kind of things and coming from someone as rude as she was about some stupid batteries!? Lady with a FOWL mouth- HAVE SOME CONSIDERATION. I'm sure there were alot of people in that same store, down that same isle looking for those same batteries.. and I'm also sure, they accepted the fact the store may have been out of batteries and went on with their happy lives! (a) A person commits an offense if he intentionally or knowingly: (1)uses abusive, indecent, profane, or vulgar language in a public place, and the language by its very utterance tends to incite an immediate breach of the peace; (2)makes an offensive gesture or display in a public place, and the gesture or display tends to incite an immediate breach of the peace; (3)creates, by chemical means, a noxious and unreasonable odor in a public place; (4)abuses or threatens a person in a public place in an obviously offensive manner; (5)makes unreasonable noise in a public place other than a sport shooting range, as defined by Section 250.001, Local Government Code, or in or near a private residence that he has no right to occupy; (6)fights with another in a public place; (7)discharges a firearm in a public place other than a public road or a sport shooting range, as defined by Section 250.001, Local Government Code; (8)displays a firearm or other deadly weapon in a public place in a manner calculated to alarm; (9)discharges a firearm on or across a public road; (10)exposes his anus or genitals in a public place and is reckless about whether another may be present who will be offended or alarmed by his act; or (11)for a lewd or unlawful purpose: (A)enters on the property of another and looks into a dwelling on the property through any window or other opening in the dwelling; (B)while on the premises of a hotel or comparable establishment, looks into a guest room not the person 's own through a window or other opening in the room; or (C)while on the premises of a public place, looks into an area such as a restroom or shower stall or changing or dressing room that is designed to provide privacy to a person using the area.

We don't know if this came from a policeman or a lawyer, but it looks pretty official.  (Editor)

"What's wrong with the F word?" What's wrong with our current society that we feel we need to accept the foul language of others in public. Instead of doing nothing and trying to stay clear of a confrontation, as most of us do, this peace officer stood up and asked the lady to calm down on her language. Instead of listening, she continued with her rebellion. I'm thankful that he was there and decided to act rather than simply walk away. The majority of our public does not want to hear the uneducated display of filth and gutter language. Try talking like that at one of the up scale stores and see how far you get. Walmart should be no different. (Note - the above does not apply to celebrities. They have their own set of weird standards)

I say it is about time.. I think we have all come way to acustom to the uttering of that word - not only in public but also in music. Recently we went for a family outing on the beach and had the idea that we would be able to listen to our selection of music.. unfotunately we were subjected to our very close neighbor's choice. We also had small children (as did they) and all were subjected to the explict choice in music. I say this as one who has used more than her share of the word - so I am by all means not claiming to superiority being above the use of foul langauage. More so I am saying that the use in a public place is and should be offensive to all within ear shot. (Seems as though even though a definition of peace officer was provided some still don't understand that he had the authority to act as he did- with that said is there any wonder of the side chosen)

While I dont use the F word on a regular basis, I have been known to let it slip when angered. Does this constitute CPS taking her child because she cussed? In this time where there are people posing as police when they are not, I would be sceptical of someone wanting to handcuff me and take me outside. AND I believe his time could be better spent out on the street stopping some of the cars with their rap so called music blaring and offending children, myself and others. I am offended to have the rap so loud I cannot hear my own radio. As law enforcement, I am sure this isnt the first or the last time this "peace" officer has ever heard this word. Is this where my tax dollars go? If so I believe they are wasted. I know you will post a nasty comment to my blog, but this is from an ordinary mom whose children have heard and I'm sure used this word.
 
So, you are more offended by rap music than someone saying "Oh F..k"  in the aisles of a grocery store where your wife and kids go to shop?  Besides that, the woman began spouting all kinds of expletives once the officer confronted her. Your tax dollars are not being wasted, you don't pay the police enough as it is.  You should cough up some more cash for what you get. I wish people would just use some common sense and not say ugly things in public. It is not a very pleasant thing, hearing someone yelling in a store or wherever, it's just rude. Are people not really reading the story?Where did it say CPS was taking her child.She was not just cited because of the F word,but what happened after she was asked to watch her language.And the officers authority is questioned.Why can't anyone understand that he is a police officer.Lord help us if it would of been a Game Warden(who also has the same authority) She made the situation worse herself. She should of been ashamed she was over heard and apoligized, then there would be no story.

It sounds to me that her family and possibly friends...if she has any, are the one responding. Obviously they have not read the entire artice which in detail describes the authority that the fire detective has been charged with by the state of Texas. He was doing his duty. I did notice that you did not mention that the offensive person not only had her 2 year old child with her but her Mother as well...hummm, is it perhaps like mother like daughter? As you pointed out will the child be like her in the not to distant future? I praise the office for doing his duty. I would be ashamed to have my name and picture plastered on the front page of any newspaper pointing out my ignorance, ill manners in public and disrespect for herself, her Mother, daughter and the officer. Maybe this officer was dealing with an individual completely stressed out by a possible hurricane, which is when this occured. Anyone remember Katrina, or Rita? Perhaps justice would have been better served explaining the law and what the end result would be if she did not cease with the profanity.I am ex NAVY and have heard it all. You want to write tickets for something offensive? How about writing them for these people that have this urge to hang there f***ing pants down around their knees! That is the most ignorant and discusting thing I have ever had to face daily. I can deal with the language myself.
 
Maybe you didn't read the story sailor.  The officer did try to talk with the woman and she exploded.  There is no law against one handing their f***ing pants down around their knees so how would anyone be able to write a ticket for it?  Duh! (Editor)

What's Wrong With The F** Word? August 14, 2008 The lucky stiff. I wish I could write a ticket to people every time I hear a string of foul language coming out of their mouths in public. I'd love to whip out a ticket book and write up the trashy teenagers and their parents who live around here to name a few.
 
Police departments all over America are needing officers.  Get hired by one of them and you can "whip out" your ticket book and start writing. (Editor)
